Professor Kevin Heller, Human Rights Watch's external legal advisor on the trial of Saddam Hussein, will discuss transitional justice and the role of amnesties.
Does an effective program of transitional justice require criminal prosecutions, a truth commission, or both?
Do amnesties have a role to play in transitional justice?
"I will argue that the very different limits of criminal prosecutions and truth commissions suggest that both are usually necessary for transitional justice to be effective. And I will contend that although amnesties are often irreconcilable with transitional justice, they can be appropriate for low-level perpetrators in the right circumstances."
