This 90 minute program provides an overview on contractual defense and indemnity as well as a brief historical summary of California indemnity law. The course also discusses various legislative efforts to mitigate the uninsured contractual defense obligation for design professionals. A detailed analysis of Senate Bill 496 and the changes to California Civil Code Section 2782.8 will also be discussed. The two prevailing and competing interpretations of the Civil Code are discussed against the backdrop various contractual indemnity provisions that have arisen in response to the amended code section. The last part of the program emphasizes contracting best practices. AIA credit eligible.
