USING CONSENSUSDOCS TO BUILD BETTER RELATIONSHIPS AND PROJECTS

ConsensusDocs is a family of standard contract documents written and endorsed by a coalition of 38 leading construction industry organizations (the ConsensusDocs Coalition). ConsensusDocs offers more than 100 different design and construction contract documents covering all methods of project delivery. The DOCS in ConsensusDocs is both an abbreviation for "Documents" and an acronym denoting the active participation of Designers, Owners, Contractors, Subcontractors, Sureties and other industry participants represented within the ConsensusDocs Coalition. The ConsensusDocs mission is to advance the design and construction industry by identifying and utilizing best practices and fairly allocating risks among the parties.

Historically, the design and construction industry has relied heavily on standard form contracts produced by associations representing a single segment of the industry. These contracts are perceived as favoring the segment of the industry which the association drafting the contracts represents. Consequently, these contracts are often heavily modified for use.  ConsensusDocs forms are designed to reduce transaction time and costs and promote the best interests of the project itself and all project participants by defining each of the parties' roles, rights, responsibilities, risks, and relationships in a fair manner which reflects and takes into account the risks inherent in each project, the realities presented, and current best practices.

This evening's presentation aims to inform construction executives, project managers, attorneys, engineers and the entire construction team about the advantages of ConsensusDocs, an alternative set of standard contract documents.

The Evening's Presenter:
PHILIP E. BECK, JD & MBA is a partner in the Atlanta, Georgia office of Smith, Currie & Hancock LLP. His practice focuses on construction law, government contracts, and commercial litigation.  Phil holds a Master of Business Administration degree from the University of Tennessee, where he received his law degree as well, and is a member of the Georgia, Florida, and Tennessee Bars.  He has been ranked as a "Georgia Super Lawyer" by the publications Law & Politics and Atlanta Magazine each year of the ranking's existence.  He is also listed annually by Chambers USA in its listing of "America's Leading Lawyers for Business" and in the publications "The Best Lawyers in America" and "The International Who's Who of Construction Lawyers".

Phil is a past Chair of the Associated General Contractors of America, Inc. (AGC)'s Service and Supply Council and a past member of AGC's Executive Board.  He currently serves as Vice Chair of AGC's Contract Documents Forum and a member of AGC's Board of Directors. Phil is also a member, and the current Vice Chair, of the Consensus DOCS Content Advisory Council, and is active in a number of other construction trade associations and construction-related organizations.  

Phil has written and lectured extensively on various topics related to the construction industry and construction law and has been a featured speaker on numerous programs sponsored by various educational institutions and construction trade associations.  Phil will have spoken on ConsensusDocs at the Construction Super Conference in December of 2012.
