Seminar Summary
In general, an architect does not have exposure to negligence claims unless their work is below the "standard of care." We will also review the most important, most misunderstood, and most fought over contractual concept, indemnity. And conclude by showing how to use these legal principles to manage your risk.
Learning Objectives:
-Attendees will learn the basis for the standard of care
-Attendees will learn how the standard of care is applied in negligence claims and lawsuits
-Attendees will learn what indemnity and the duty to defend means in their contract
-Attendees will learn how to minimize risk in their contracts
Speaker(s) Biography:
Ryan Kohler, is a partner at the law firm of Collins Collins Muir + Stewart. Ryan works extensively with design professionals in the architecture and engineering world on business disputes, contracts, and professional liability defense. He has successfully defended design professionals from claims in trials, arbitrations, and administrative hearings.
Brian Stewart, Hon. AIA, is a partner at the law firm of Collins Collins Muir + Stewart. Brian has defended numerous architects and engineers in trial, is an affiliate member of the AIA|LA and of ACEC, and has published numerous articles to help design professionals.
