9:00 a.m.  Panel Discussion On Trying Criminal Cases in Montana Federal Courts

A panel of prosecutors and criminal defense attorneys that have recently tried cases in federal court in Montana.

Tim Racicot - Assistant United States Attorney.  

Tim has been an Assistant United States attorney for twelve years.  In that time he has tried multiple criminal cases.  Prior to becoming an AUSA, Tim worked in the Department of Justice and clerked for a federal district court judge.

Tara Elliot -  Assistant United States Attorney.  

Tara has been an Assistant United States Attorney for eight years.  Prior to becoming an AUSA, Tara worked at the New York County District Attorneys Office in New York City.  She has tried over 50 jury trials in her time as a prosecutor.

Andrew Nelson - Assistant Federal Defender in Missoula.  

Prior to joining the Federal Defenders in 2009, Andy was an associate attorney with the law firm of Smith & Thiel before becoming a partner with Mudd Nelson, P.C.  He was a Law Clerk to the Honorable Terry Trieweiler, Justice of the Montana Supreme Court shortly after law school.  Andy was a member of the Criminal Justice Act panel for the District of Montana for five years.  Andy has advanced training in forensic science litigation from the Cardozo School of Law and the National Association of Criminal Defense Lawyers (NACDL).  

Peter Lacny - CJA Panel Member.

In his criminal practice Peter has obtained trial acquittals for accused clients in federal and state courts. He has handled appeals to the Ninth Circuit Court of Appeals, the Montana Supreme Court and the United States Supreme Court.  He has represented hundreds of accused criminal clients in all types of criminal cases.  Peter is a proud member of the District of Montanas Criminal Justice Act Panel, where he provides federal criminal defense services to indigent defendants.  He has recently tried a criminal CJA case to a jury.

Andres Haladay - Drake Law Firm.

Andres Haladay is an Associate at Drake Law Firm in Helena.  He has previously served as a clerk for the Montana Supreme Court, a Public Defender and an Assistant Attorney General.  Andres is also currently a Helena City Commissioner.  Andres has recently tried a civil jury trial in Montana Federal District Court, concerning State and Federal civil rights claims.

Alex Rate - American Civil Liberties Union legal director for Montana.  

Prior to accepting his position as ACLU legal director for Montana, Alex represented plaintiffs in federal court in civil rights and employment discrimination cases.

Justin Stalpes - Partner at Beck, Amsden and Stalpes.  

Justin has recently represented plaintiffs against the government and corporations in federal trials.

Mark S. Smith - Assistant United States Attorney.

Mark Smith has been an AUSA for the District of Montana since 2002, and was recently named the District's Senior Litigation Counsel.  He has tried numerous cases in federal court, in both jury and non-jury trials and dispositive motions.


Liesel Shoquist - Shareholder at Milodragovich, Dale & Steinbrenner.  

Liesel litigates cases relating to personal injury, property damage and employment disputes, among others.  She recently tried a case to a jury in federal court.

Tips from recent federal law clerks on their role and what they wish you had known that could have helped them help you move your cases forward.


Randy Tanner - Associate Attorney at Boone Karlberg.

Randy's practice consists primarily of complex civil litigation and state and federal appeals. During law school, Randy was Co Editor-in-Chief of the Montana Law Review and a member of the National Moot Court Team. Randy clerked for the Honorable Sidney R. Thomas of the United States Court of Appeals for the Ninth Circuit and the Honorable Donald W. Molloy of the United States District Court of the District of Montana.

Katy Stack - Partner at Stack and Kottke in Missoula.  

Katy served as a judicial law clerk for two federal judges: United States Magistrate Judge Keith Strong in Great Falls from 2010-2012 and Chief United States District Judge Dana L. Christensen in Missoula from 2012-2014.  Katy also earned valuable trial experience interning at the Missoula County Attorney's Office from 2009-2010.  

Mac Morris - Associate Attorney at Crowley Fleck

Mac Morris served as a law clerk to the Honorable Dana L. Christensen, Chief Judge for the United States District Court for the District of Montana, from 2013 to 2015.  He is an associate at Crowley Fleck PLLP in Bozeman.  His practice focuses on tort litigation, products liability, commercial litigation, and insurance.  Mac graduated with high honors from the University of Montana School of Law in 2013, where he was Articles Editor of the Montana Law Review and a member of the School of Laws Trial Team.

Emma Mediak - Associate at Garlington, Lohn and Robinson.  

Emma graduated from Stanford Law School in 2012. While in law school, Emma served as Editor-in-Chief on the Stanford Environmental Law Journal. After completing her schooling, Emma returned to Montana, where she clerked for the Honorable Justice Brian Morris on the Montana Supreme Court. She also spent a year prosecuting felony and misdemeanor crimes in Beaverhead County before returning to clerk for Judge Brian Morris after he was confirmed as a United States District Court judge.

2:30 p.m.  United States District Judge William G. Young of the District of Massachusetts.  

Honorable William G. Young, Judge of the United States District Court, District of Massachusetts, has been an active trial judge for almost 40 years, serving on both the Massachusetts Superior Court (1977-85) and the United States District Court for the District of Massachusetts (1985-present). After receiving his A.B., magna cum laude, from Harvard University in 1962, he served two years as an officer in the United States Army. His legal career began in 1967 when he was admitted to the Massachusetts bar upon graduating from the Harvard Law School.

He served as law clerk to the Honorable Raymond S. Wilkins, Chief Justice of the Supreme Judicial Court. Following his clerkship, he practiced law as an associate and then partner at the Boston law firm of Bingham, Dana & Gould. His legal career has also included stints as a Special Assistant Attorney General and as Chief Counsel for former Massachusetts Governor Francis W. Sargent.

A longtime teacher of evidence and trial advocacy, he has taught at several law schools including Harvard, Boston College, and Boston University. Commonly referred to as the Education Judge, he is active in judicial education at the Federal Judicial Center and the Flaschner Judicial Institute. Moreover, he volunteers much of his time to educating the bar and has been a staple at continuing legal education programs and institutions including Virginia Continuing Legal Education and the Practicing Law Institute (PLI). He has won national acclaim for his work on the Massachusetts Continuing Legal Educations annual lecture series On Trial with Judge Young, which offers each fall an intensive 15-week study of trial techniques and trial evidence.

In addition to teaching in the classroom, Judge Young has written extensively. He is the principal author of Massachusetts Evidentiary Standards (1992 through 2005 eds.) and Vols. 19 and 19A, Evidence (Mass. Practice Series 1998), and co-author of Dauberts Gatekeeper: The Role of the District Judge in Admitting Expert Testimony (Tulane Law Review), and An Open Letter to U.S.District Judges, The Federal Lawyer (July 2003).
