4 Credit CLE - How to Obtain Records from Social Media, Search Engines, Apps and Cellular Providers
The availability and quantity of information online has revolutionized practically every field within the past decade, and it is vital for those within these numerous fields to update their skills and knowledge. The legal profession is no exception. User generated content from social media platforms, user-made websites, email conversations, cellular and mobile device data can now be used as a vital resource of information for any number of cases.

This course offered by the Toonari Corporation is aimed at educating legal professionals who are interested obtaining records from providers during E-discovery. E-discovery refers to the identification, preservation, and collection of information stored digitally or electronically. Our primary goal during these trainings is to introduce legal professionals to the wealth of information available to them and the resources to identify, preserve, obtain, understand, analyze and ultimately illustrate electronic evidence to a jury. We provide very brief overviews of social media platforms in order to bring legal professionals up to speed with the latest technology and information available; however, these explanations are given for the sole purpose of explaining how to find relevant information for cases using the social media platforms and other sites used to analyze data from social media networks.

Focused instruction is provided on what legal process such as subpoenas or court orders are necessary to obtain information that goes beyond the scope of open source social media data. Often this data is sought to augment the open source evidence available through available content on social media platforms and to confirm a user's identity, whereabouts, establish a timeline or confirm or refute an alibi. Subsequent instruction illustrates what information to request from companies such as Facebook, Verizon, Comcast or Google, how to interpret the data once provided, and finally considerations for analyzing the data properly and presenting it to a jury. Instruction illustrates and parallels the guidelines and restrictions in both the Electronic Communications Privacy Act and Stored Communications Act.

Law Enforcement Consultant, Ft. Lauderdale, FL

With over 15 years experience in law enforcement, Robert Mauro has successfully uncovered some of the most devious predators that used the internet and cellular devices to prey on children, the elderly and many others. Robert has extensive experience in drafting and serving legal process on Internet and Communications Service Providers to obtain inculpatory evidence. Robert has testified in federal court as an expert in internet investigations and assisted with electronic evidence pertaining to homicide, robbery, missing persons, fraud and burglary.  Robert is an active member of the  South Florida Internet Crimes against Children Task Force and FBI Innocent Images Task Force. Robert has shared his knowledge and expertise at conferences throughout Florida including a presentation to the FBI National Training Academy Leadership class in 2011. Robert has received awards from Broward County Victims Rights Coalition, FBI Directors Award, and the United States Attorney's Office for his work to combat child exploitation.


Dennis R. Nicewander
Assistant State Attorney, 17th Judicial Circuit in Broward County, FL

Dennis Nicewander has been an Assistant State Attorney for the  17th Judicial Circuit in Broward County, Florida since 1987. After prosecuting a variety of criminal cases for three years, he was assigned to the Sex Crimes/Child Abuse Unit in 1990, where he successfully prosecuted numerous high profile cases. In 1998, Broward County was awarded one of the initial Internet Crimes Against Children grants where Dennis got involved immediately. Since that time, he has been the prosecutor assigned to the ICAC Task Force and provides legal guidance to law enforcement throughout the Task Force's jurisdiction of over 5 million people. He has participated in hundreds of investigations and successfully prosecuted over 400 ICAC cases.



Karhrman Ziegenbein

Karhrman Ziegenbein is the CEO and Co-founder of Toonari Corp. An expert in Authenticated Social and Web Media Evidence Collection, he has worked for companies such as Microsoft, Nelnet, Travelers & Capital One. In his industry, he has become an expert in Data Mining, Machine Learning and Analytics. Karhrman served in the Armed Forces of his native Germany as a Combat Medic. Currently, Karhrman is an active Member of the Kiwanis Club of St. Petersburg and serves as a member for both the American Bar Association and the Armed Forces Communications and Electronics Association (AFCEA).


Greig Gilbert
Chief, Intelligence Operations [Toonari Corporation]

Greig Gilbert is an expert in the Intelligence field. As an Air Force Veteran, he spent time in Iraq, working Intelligence for Navy SEAL Teams and Coalition Forces. In his position as Senior Intelligence Analyst, Greig managed over 80 Intelligence Analysts at the Joint Intelligence Center for Special Operations Command Central (SOCCENT). Greig was awarded Intelligence Senior Non-Commissioned Officer of the Year and Top Senior Enlisted Intelligence Professional for 14th Air Force. He also has worked with companies such as SRA International and L3 Communications. During his career with the US Air Force, Greig planned, developed, and directly managed Intelligence Training and Quality Control Programs in many units throughout the world. Greig utilizes his extensive background in intelligence gathering and analysis in Toonari's operations as a Cyber Intelligence Analyst.
